Our firm recently received in the mail a letter that appears similar to an official government form. Upon review of this letter it is merely potentially deceptive solicitation.
The letter was addressed to Colorado Businesses with the message, “INSIDE: 12 Federal and Colorado Regulations Affecting Your Employees Immediate Response Requested.” Because it is likely that you too will receive this piece of mail, we felt it necessary to advise you that it does not require you to purchase anything or take any action. The notice is sent by a commercial supplier hoping to sell Colorado & Federal Employment Law Posters that comply with employee notice and posting laws.
Note: there is one new regulation that may affect your business. The National Labor Relations Board (“NLRB”) recently passed a rule that requires businesses with at least 20% of employees who are not proficient in English to post a notice of NLRB rights, effective January 31, 2012. The notice can be downloaded for free from the NLRB website, and printed in color or in black & white on one 11 x 17 piece of paper or two 8 x 11 pieces of paper. Alternatively, a poster displaying all of the required employee notice postings can be purchased from this or another commercial office supplier.
Please be aware that potentially deceptive solicitations may:
• Appear similar to a government form;
• Contain an official-looking seal;
• Refer to a statute or quote other Acts or laws;
• Imply that failing to return the form and pay a fee may place your company in jeopardy, may “pierce the corporate veil”, or might cause your company’s filings with the state to be noncompliant; and/or
• Contain a “Corp Number” or “Corporate Identification Number” that does not match a number given to you by a State or Federal Agency.
